When asked if they handle employment or wrongful termination claims, attorneys frequently say, “I’m sorry, but we don’t handle those sorts of issues.” John M. Eccher and Paige Sparks of the Eccher Law Group will discuss ideas for attorneys who don’t generally “handle those sorts of matters” to identify deadlines and critical factors to assist assess if a viable case exists in this presentation. Mr. Eccher and Ms. Sparks, who devote a significant amount of their practice to defending plaintiffs in such cases, will also give a road map for taking the first measures to safeguard both the potential claimant and the law firm itself.
Points to Consider:
a) Deadlines/Limitation Statutes: Strict deadlines are likely to apply in any employment situation, whether the individual is still employed or has been terminated, with some requiring action on the same day. This lecture will assist practitioners in identifying any such deadlines so that they may take appropriate action to safeguard such employees/former employees…and themselves.
b) Applicable Law/Identifying Viable Claims: Employment law is more difficult than normal “personal injury claims,” especially given the specialized deadlines, administrative processes, and recent changes in the law. This lecture will offer an overview of Missouri employment law claims.
b) The Intake Procedure: “So, what information do I require? How do I go about obtaining it?” Mr. Eccher and Ms. Sparks will describe their “intake process” for preparing to examine cases for prosecution in this session.
d) Initial Steps: Whether drafting a letter to an employer on behalf of an employee, requesting a service letter, filing a Charge of Discrimination, or filing a lawsuit, the purpose of this presentation is to provide a basic understanding of the first steps to take in an employment matter and how to do so.
e) “CYA:” Mr. Eccher and Mrs. Sparks will also discuss some of the measures they take during the employment intake/representation process to document conversations, confirm possible client/client understandings, decline/terminate representation, and so on.
