Texas Medical Board Investigations: How to Handle an Initial Inquiry and Formal Investigation

During this session, the speakers will go through and discuss the Texas Medical Board’s inquiry procedure.
Objectives of Learning:
Understand the investigation process, including how investigations are begun, the initial inquiry phase, the formal investigation, and the best way to react.
Understand the standard time periods, internal stages, and some of the most typical errors made by doctors AND ESPECIALLY ATTORNEYS when replying to requests.
The American Osteopathic Association has recognized the Texas Osteopathic Medical Association (TOMA) to conduct osteopathic continuing medical education for doctors. TOMA has designated this program for up to 1.5 AOA Category 1-A credits and will report CME and speciality credits in proportion to the level of the physician’s involvement in this activity.
Dr. David Garza, a full-time member of the UIWSOM faculty in San Antonio, is the Clerkship Director for the Family Medicine and Rural/Underserved Medicine Rotations, the Director of Osteopathic Recognition for GME, and the Medical Director for UIW Health Services. After twenty-five years of solo practice in Laredo, Dr. Garza became the Founding Program Director of UIWSOM’s Family Medicine Residency, where he continues to precept residents every week. He graduated from UNTHSC-TCOM with a D.O. and a Master of Medical Education Leadership from UNECOM. Dr. Garza, who is board certified in family medicine, served on the Texas Medical Board for seven years. He is an ACOFP and AAFP Fellow, as well as a previous president of TOMA, Texas ACOFP, TMF Health Quality Institute, and TCOM Alumni Association.

Mr. McDonald is a founding partner of the Austin, Texas-based legal firm McDonald, Mackay & Weitz, L.L.P. Jeff has been a licensed attorney in Texas since 1988 and has worked in both the public and private sectors. He formerly worked as an Assistant City Attorney for the City of Austin, as well as the Texas Medical Board’s Director of Hearings and Compliance, as well as the Texas Physician Assistant Board and the Texas Acupuncture Board. He is Texas Board of Legal Specialization Board Certified in Administrative Law, and his present practice focuses mostly on physician licensure defense, medical license defense, general administrative law, and professional licensing for health care professionals, among other services. Mr. McDonald also serves as the Impaired Physician Committee’s Field Representative. He regularly deals with medical professionals who are struggling with substance dependency or mental illness.
